Can You Resell an Off-Plan Property in Dubai Before Handover?

A very common question from off-plan buyers in Dubai is this: can I resell before handover, or do I have to wait until the property is completed?
In principle, yes, resale before handover is possible in Dubai. The legal basis is that real property units sold off-plan and entered in the Interim Property Register may be disposed of by way of sale, mortgage, or any other legal disposition. Dubai law also makes clear that any disposition relating to an off-plan unit must be entered in that register, otherwise it is void. (dlp.dubai.gov.ae)
That is the important starting point. Dubai’s framework does not treat all off-plan units as locked until completion. In fact, Dubai Land Department’s own service for initial sale registration specifically refers to off-plan units whose value has not been fully paid being registered on the provisional register. That supports the general point that full payment and final handover are not the legal pre-condition for every transfer-related step in the off-plan lifecycle. (Dubai Land Department)
However, buyers should be careful not to confuse legal possibility with automatic entitlement. Many people in the market say resale is allowed once 30% to 40% of the price has been paid. That may be true for some projects as a matter of developer policy or sale contract terms, but in the DLD legislation reviewed here, I did not find a single universal statutory rule imposing one fixed resale threshold for all Dubai developers. In other words, the real answer usually has two layers. First, the project itself must be properly approved and the off-plan interest properly registered. Dubai law states that no developer or broker may sell off-plan units in projects that are not approved by the competent authorities, and any such contract is null and void. Second, your own SPA and developer procedures will often govern when the developer will process or recognise a resale request in practice. The law expressly says developers cannot charge fees on sale or resale of completed or off-plan units except administrative costs approved by the Department, which is another sign that the developer remains part of the process. For investors, the practical takeaway is simple: read the SPA carefully before assuming you can flip the unit whenever you like. You should check whether the project is registered with RERA, whether there is an escrow account, the percentage of completion, whether the developer is properly registered, and whether the developer has the required permits and approvals to sell units off-plan. You should also keep transfer costs in mind. DLD’s investor guide says the registration of a sale and purchase contract attracts a fee of 4% of the purchase price, usually shared equally between seller and buyer unless agreed otherwise. So, can you resell before handover in Dubai? Usually yes, but not simply because “someone said 30% is enough.” The safer answer is this: if the off-plan unit is properly registered, the project is approved, and your SPA plus developer process allow the transfer, a pre-handover resale can generally be done.
